These Terms & Conditions (“Terms”) govern your use of products sold or distributed by Allan Lobo LTDA (“Licensor”, “we”, “us”). By purchasing, downloading, or using any product, you agree to these Terms.

1) What these Terms cover

Products include, as applicable:

• Presets – sound design files/patches for instruments such as Arturia V Collection, Pigments, Cherry Audio Lowdown, etc.
• Performance files – e.g., Apple MainStage concerts, Gig Performer gigs, controller mappings/splits/layers.
• Samples & audio – bonus WAVs, demo audio, and other recordings.
• Documentation, text, artwork, and other materials.

2) License grant (what you’re allowed to do)

Upon purchase (or download, for freebies), you receive a personal, non-exclusive, non-transferable, worldwide license to:

• Install the product on up to 3 computers you own and control.
• Use and modify the presets/performance files within your own musical work (live shows, recordings, YouTube, film/TV/games, streaming, etc.), including commercial releases.
• Use any included WAV samples or demo audio within your own musical work (not for re-packaging).
• No credit/attribution is required (though always appreciated).

3) Restrictions (what you’re not allowed to do)

You may not:

• Share, resell, publish, gift, upload, or redistribute the presets, performance files, samples, or any portion of the product as files, whether original or modified.
• Include our presets, performance files, or samples in any competing product, preset bank, sample/loop pack, app, or soundware.
• Use our content to train AI or machine-learning models or include it in any dataset for that purpose.
• Transfer or sell your license to another person or organization. (Single-user license. Contact us for multi-seat / institutional licensing.)

4) Ownership & intellectual property

• All audio recordings (WAVs), documentation, text, artwork/graphics, and branding are © Allan Lobo LTDA.
• Presets and performance files are proprietary configurations and are licensed, not sold. All rights (including any copyright, database rights, or compilation/selection rights where applicable) remain with Allan Lobo LTDA.
• Third-party names (e.g., artists, bands, instruments, software) are used descriptively. We are not affiliated with or endorsed by any third party unless explicitly stated.

5) Compatibility & third-party software

Some products require specific third-party software and versions (e.g., Arturia Analog Lab/Pigments, Apple MainStage [Mac-only], Gig Performer, etc.). You are responsible for owning valid licenses for required software. We are not liable for changes made by third-party vendors that affect compatibility, though we’ll always try to help.

6) Delivery, updates & access

• Delivery is via Payhip download links to the email used at checkout.
• Lifetime access means ongoing access to your downloads for the life of the product and our store; we may update files occasionally at our discretion. We may introduce paid upgrades as new products.
• Please back up your downloads; re-download availability is provided as a convenience.

7) Refunds & Cancellation Rights

Due to the non-tangible, irrevocable nature of digital goods, special rules apply:

• Digital Sound Packs: By proceeding with your download, you explicitly consent to the immediate supply of the Digital Content and acknowledge that you waive your 14-day cancellation rights. All sales are final once the download link has been accessed.
• Technical Support: If you experience issues, contact support@allanlobo.net. We reserve the right to verify reported technical errors (e.g., via screenshots) before considering any exceptions.
• Online Courses: We offer a 15-day "No Questions Asked" Money-Back Guarantee for educational programs (e.g., APEX Keyboard Academy and APEX Synth Academy).
• Refund Processing: All authorized refunds are processed exclusively to the original payment method. We do not issue refunds to third-party accounts (e.g., alternative PayPal emails).

8) Free/bonus samples & third-party content

Occasionally products may include bonus WAV samples (e.g., intros/cues). These are provided free of charge for your convenience. You are responsible for ensuring your use is lawful in your territory (especially when samples emulate or are inspired by well-known recordings). When in doubt, seek clearance.

9) Support

10) Termination

If you breach these Terms, your license terminates automatically and you must delete all copies. Our other rights and remedies remain available.

11) Disclaimer, Warranties, and Limitation of Liability

• "As Is" Provision: All products and digital content are supplied “as is” and "as available," without warranty of any kind, whether express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• No Guarantee of Results: While we strive for the highest quality, we do not warrant that the products will meet your specific requirements, be compatible with every third-party software update, or that the operation of the digital files will be uninterrupted or error-free.
• Limitation of Damages: To the maximum extent permitted by law, Allan Lobo LTDA shall not be responsible for any loss, direct, indirect, incidental, consequential, or other damages (including, but not limited to, loss of data, loss of profits, or business interruption) which you may suffer by purchasing, downloading, using, or relying on the digital content in any way.
• Liability Cap: In any event, our total liability for any claim related to a product—regardless of the nature of the claim—is strictly limited to the actual amount you paid for that specific product.

12) Payments, taxes & VAT

Payments are processed by Payhip/Hotmart/Stripe/PayPal. VAT/GST and similar taxes may be collected and remitted where applicable based on your location.

13) Governing law

These Terms are governed by the laws of Brazil. Any disputes will be handled in the courts of Curitiba, Paraná, unless a different forum is required by consumer law.

14) Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page. Material changes will apply going forward.
